From: E on Friday, August 27, 1999 State: New York Story: Caught driving 68 Mph on and open country road. No signs for speed. Officer equipped with Doppler radar caught me in the opposite direction. He hugged behind opposite traffic. I was coming down a hill, he got me at the bottom. Although there was no signs, NY law max speed is 55 mph. I was 13 mph over. My insurance company will forgive this first offense $$ (on my record for 3 yrs). The officer says you can take school to remove the mark. The town court clerk told me on the phone they do not plead down with school (??). My meeting with the town prosecutor isn't till later this month. I pleaded not guilty, only because I wanted to see what the prosecutor has to say. You have 48 hours to send in the ticket with a written guilty plea which I waited to long, 3 days. I also marked "Request for Officer deposition". I didn't know entirely what this was. I found out later that requesting this forces the officer to write out why he gave me a ticket. I also found out if I don't receive this, the case can be dismissed under CPL-100.25, "missing supporting documentation"?? Well, I got my deposition and now waiting for the meeting with the prosecutor at the end of the month. I think I'm going to plea no contest and take the hit. The only thing I can go on is my build-up of speed down the hill but you must have control over your vehicle at all times and use brakes to maintain your speed. I expect to pay at least $100 for this. |
