From: Stephen J. Olson on Monday, October 19, 1998 State: Pennsylvania Story: I was traveling in the borough of Dauphin. I was pulled over for speeding, 54.5 mph in 25 mph zone, using VASCAR. I did research and this is what I was able to prove.... I got the township's engineering survey for the area that I was pulled over. From where I turned onto the street to the end of the timing area, the distance is 770 feet. I then went to an old issue of Car & Driver. I found the test results for my vehicle. The time/distance curve showed that on a sunny southern California day, a brand new Geo Tracker with a professional driver could not match that speed. In other words, the car couldn't possibly go that fast. I got a VASCAR user's manual. It states that when using the device at night, the lines have to have a three foot reflective pole or something similar along with the lines on the road. They did not have that. I also got the newspaper for that day, showing sunset time of 5:30 and my ticket was issued at 5:52. Last, but not least, the clincher was also found in the owner's manual. The manufacturer's minimum recommended distance for this particular unit is 200 feet in parked mode 500 feet in moving mode. The officer was parked, but the lines were only 100 feet apart. Needless to say, I won my case. :) I have also beat tickets for other people by doing research. The biggest mistake I've seen is the incorrect citation subpart. The section is 3362. Then there is an a1 and a2 with subsections abc. (there is another one added now that there is a 65mph limit. Anyway, they usually put down 3362 a2b, which is exceeded 55mph by the amount shown. They mistakenly put this on the ticket for speeding in a 40mph zone. For example, you get a ticket for 57 in a 40mph zone. The ticket says you were exceeding 55mph by 17mph. The officer will testify that he clocked you at 57. You simply state in court that the ticket is for 72mph and you were not going 72mph! I won two cases like that. |
